I am waiting on any word from Mark. He has made no attempt to contact me since the last excuse was given as to why these were not at my house yet. I informed them I would be working long hours all week this week because of a plant issue, and as of this moment I am still on the plant floor, so I am unable to be on top of this as much as I would like.

Last I was told was that the shipment arrived via DHL. They tried to drop off a few times, but no-one was at the house, or something. I told him to go pick them up, and he then called and said he was on his way to pick them up, this was Friday. Then Saturday he calls to tell me we can't ship them, because DHL closed at 1pm on Saturday. (No idea why he was on his way to pick them up and then didn't...) Then I was told Lisa would pick them up Monday after school. Then Monday night I get a text that his father had a heartattack and he's at the hospital. I asked about the bodies and Lisa said he hadn't done anything because he was at the hospital. I then *****ed because they would get shipped back (if they were indeed here), and I got a text that he changed the delivery to his work for the next day (Tuesday). I sent a text yesterday to both of them with one question... "Bodies?" No reply from either, nor any info today.

Obviously it sounds like crap again, I see it, and I know you do too. I am sorry if his father is in the hospital, that crap sucks, but he has obligated himself to deliver these bodies to everyone involved. No matter what comes up in life, you still have to follow through. I contacted my lawyer already, and I have paperwork ready to be served, if this goes on much longer. There is no way I am letting him screw you guys, or me. He's in a hole, and its getting deeper by the day.

I would prefer that paypal disputes not be filed, only because it will complicate things. However, if you want to go this route, then please do it quickly. I will not fault anyone for going this route, as it is the safest from someone elses point of view. However, those that know me know I am a man of my word. I will either get you money back, or a body in hand, one or the other.

Mark, if you read this then you had better get ahold of me.

I highly doubt his father is in the hospital. Not to be a dick, but remember that he told Seaneyo99 that his best friend was killed in a carjacking over the laptop deal, and it was a bull**** story. We know that he doesn't mind making **** up about his friends, I wouldn't put it past him to do it with his father either.

I filed a paypal dispute on the last day I was able to. I'm glad I did. I checked the status of it today, and it said that he had not responded to the dispute and he has until tomorrow or they will automatically be ruling in my favor. Even if do get my money back, I don't like knowing that someone tried to screw me. $30.00 or $30,000.00....I'm still not cool giving it away to a lowlife thief that doesn't deserve a toilet to piss in.

He sold the same laptop to three people. He organized a group buy with apparently no intent to deliver the product or cooperate when you took it over. He seriously needs to have some charges brought against him...I hope you are serious about going to your lawyer about this and following through.

Whatever you need John....

I dont know how DHL works. But why not sign the slip and leave it for the driver for delivery? I have done that for UPS a million times. They attempt delivery leave a slip, sign it and they will leave it where requested.

DHL will attempt 3 deliveries before the package is AUTOMATICALLY shipped back to the sender... unless you call them and say "hold for pickup" [which they dont have a set time they will hold it before shipping it back to the sender]... eitherway, I'm very doubtful the package is still waiting at DHL.

I know with UPS they will try the 3 times and then send you a notice and you have I think 3 to 5 days after that to pick the item up.

I write shipping software for a living [and I know I've mentioned this a number of times]. DHL out of all the carriers is the most horrendious. My boss keeps saying "DHL has yet to figure out they are in the shipping business"... alot of their practices are not documented and typically you cant get a definitive answer... I just called our rep this morning for delivery policies and that previous post was a good example of this.

eitherway, yes there are plenty of things you could blame DHL on but HONESTLY my money's [literally] on Saleen on this one.

Honestly, if you haven't already, open a dispute with him if you paid with Paypal. If you paid by certified check or other method talk to your bank or wait for a response from E1.

It's been a couple days since we've gotten an update and I wouldn't give him any benefit of a doubt.

I was going to open a dispute last week. THen E1 came on and said they were shipped. After asked for a tracking number he said not to worry he was taking it over and we would get something and to stop complaining.

Now I think its too late to file a dispute and it made a big mistake listening to someone else on this. :mad: I knew that shipping statement was a load of crap. Which is why I persisited on asking for a tracking number. I guess that was too much information to ask.

Maybe he'll come through and get this taken care of. I think its too late to get the bodies from the original group buy. Guess we'll see though.

Sorry guys, I'm still trying. As of right now he has avoided me like the plague.

I just got off of the phone with the local police department, filled out the paperwork, and had them contact my lawyer. According to Federal law, Mark is guilty of Federal Interstate Wire Fraud, which is a Felony and punishable by up to $100k and 5 years in prison. I am still waiting to see how I should handle the refunds, as it depends on if we continue with the federal charges, or if this turns into a civil class-action suit on behalf of NECO.

I also have a call into HPI, and they are sending me a small run of the Cougar bodies. Those of you who still want the bodies can get them from me direct, if you already paid Mark then I will not charge you, obviously, but I will need a signed statement showing that I am now the responsible party for the money that Mark defrauded you of. I will get all of this together shortly.

If anyone wants to discuss this with me in person or on the phone, please feel free to PM me with a phone # and best time to call to talk, and I'll get right back with you. I'm available after 5pm all week.

Me too. I'm over in the UK, paid for two bodies and a rather hefty amount on postage. Best part of $95 in total, so.....I'm not that pleased! :disgust:

Got to admit I'm glad that someone reliable has taken this on though. Its much appreciated.

I'm still waiting to find that out from HPI. As of right now I have confirmed that the original order DID go through, and they bodies were shipped and then returned. (This despite me warning that this is exactly what would happen if he BS'd with the shipment.)

Right now I'm trying to find out if they are going to reship them to me, or if they will just refund the money from the order. (I'd bet HPI still wants the sale, namely so they cover their own costs on this.)

And trust me, I want my body too, since I'm sitting on a pretty new Nitro car w/ no body. :P

As an FYI to everyone who is still in the GB, I received confirmation from HPI that the bodies are being reshipped to my house next week. HPI has been VERY slow to reply to anything, which is also why Eric nor myself could not confirm that the bodies were ordered originally by Mark. (Which they were, btw.)

I just think that maybe you should have just let us deal with this through paypal instead of stepping up saying everything was OK (when it wasn't) and *****ing everyone out because they were concerned about this group buy going down hill. Which it DID. You kept saying don't worry about it and quit gripping but we had a legitimate concern about problems. I commend you for stepping up and taking it over but just think maybe you shouldn't have backed someone that apparently wasn't going to come through. Friend or not he is a shady person and shouldn't have started this in the first place. GL with the bodies and maybe it will work out. I have other things going on and would rather get my money back and pick one up later.

Actually, if you think about it, nothing was "going down hill" until long after I took over. The bodies were ordered by Mark, he did not lie about that. The bodies were produced on the date he said they would be, he did not lie about that. The bodies were shipped right when he said they would be, he did not lie about that. Check the dates of my posts when I said that, and tell me again why you thought things were not ok back then?

What he did do was slack off majorly on posting updates for ya'll here. He also then got fed up with everyone assuming it wasn't legit and started slacking on picking up the shipment (even though I warned him it'd get sent back), and then once it did things just got worse from there.

Would I stand up for a someone who is a friend today? Damn right. Will one of these "friends" screw me over in the future? Most likely, but then that's an easy way to weed out the true friends, eh? Friendship and loyalty means a lot to me, its part of my nature and the Marine in me.

Nope, refunds out of my personal funds will be as the money becomes available, which will not be this month. Right now my kids Christmas presents are much higher priority than paying anybody back for Mark.

Right now I am in limbo, I've been out all week with a back injury, and Mark no longer replies to phone calls or text messages. I sent one final message to him today, and then I'm going to pay a visit to his work, parents, everybody. Nothing much else I can do, I rode his ass as much as possible and he hides like a little girl.

Yeah. Its been 25 days since I asked Eternalone for a refund and nothing yet.

And as I told you multiple times I will get you a refund WHEN IT IS CONVENIENT FOR ME. Or you can take the other choice I gave you, and try and get your money back yourself -- but do NOT demand anything from me, because I could care less if YOU get your money back or not.

Here's is where we are...

#1 - We know the bodies were paid for, this has been confirmed by multiple people.
#2 - We know the bodies were shipped at one point, but were returned.
#3 - The tracking number that was given to me was not valid, as I figured. So I am positive they were never reshipped to me.
#4 - Mark is now ignoring every text message and phone call I make.
#5 - Mark has been slowly paying people back that he screwed over.

I just sent another text message, however I am very busy for the next month, while the automotive world shuts down for Christmas is when we do all of our 1/2 model year upgrades to the lines. I will not have a chance to get to his house for another week or so, but I do plan on going and visiting his parents and letting them know everything -- parents tend to be able to handle kids a bit better. Other than that, no new news from me...

Seriously. How has HPI not been in direct contact with you about shipping these back TO YOU by now?

This GB started back in August, September was quiet things went sour in October, things looked up in November and December went buy with nothing. Why is HPI not shipping YOU the bodies directly and if they are wtf is taking so long for this to be resolved?

Everyone except this GB has been handled, as far as I know. On top of that Mark contacted me over the weekend and has calculated out the amount of money he owes me to repay everyone for this GB, so I am waiting on him to pay me for that and then I will issue everyone else refunds.

Sorry, but it looks like no bodies guys, but as I said I would either get you the bodies you ordered or your money back. The end result here is I am making sure no-one gets screwed outta cash.

Oh yeah, and Rodney, I still feel you were being a little girl crying to Trevor because you had to wait a few more weeks... Yer just lucky Trevor was nice to pay you himself -- you had long since earned yourself the 'last to be paid' title from me...

I wasn't going to say anything but this is just ridiculous. I wasn't crying like anything. I was doing what I felt needed to be done to get my cash back in a timely manner. I asked for a refund back on November 18. For some reason you got an attitude about it. Maybe I wrote something that you took the wrong way. I dunno. You decided to blow me off and got some sort of attitude everytime I asked about it. You were the one who said you are taking over the group buy and to ask you for a refund. In fact you mentioned it in other threads in the feedback area too. It was obvious you had some sort of hostility towards me and I thought a month of negative attitude and being ingnored was too long to wait for a simple refund.

You can call me a crying girl.. a sissy... or whatever you want. I know who I am and don't really care. This is just plain childish and I'm way past the 6th grade.

You're really getting on my last nerve here with this ****. I (me personally) will be helping Lisa package these to ship them out. Anyone has a problem with this, contact ME and I will GLADLY refund your money, as I stated before. You hear that? I am FUNDING THIS now.
