I was on my way to work last night, on one of the backroads near my house, waiting to make a left hand turn (wheels aimed straight ahead, not cut left). I saw a car coming around a corner maybe 100 feet away going about 60mph. So I decide not to chance it by turning out in front of the car. I then see the headlights start coming across the double yellows into my lane. I just froze up and nearly wet my pants. It was like it was happening in slow motion, I was watching this Camry come straight at the front my baby at "OMFG, he's gonna kill me" speed. I dunno how but I snapped back into reality at the last (and I mean last) possible second, cut the wheel right, let out the clutch and floored it, driving onto someone's lawn. As I'm doing this, the Camry comes fully into my lane, moving about 20 feet past me (still in my lane) before swerving hard back into his. It seemed like he had the pedal down the whole time and didn't even see me... Until I whipped the Coug around and floored it. I know it was the wrong thing to do, but I was seeing red. Road rage was the understatement of the year. I ended up following him for about 2 minutes, watching him swerve in and out of his lane before he pulled into his driveway. I parked right at the end of it, grabbed my Maglite and started to get out of the Cougar (still enraged) when I saw the real shocking part of all this... The drunk bastard had his kid (looked to be about 3) in the front seat with no child seat or anything. I ended up getting back in my car and calling the cops. Lucky for me, there's always a cruiser on 118, so they were there in just under a minute and he was still standing by his car, staring at me. Long and short of it, he failed the field sobriety test and I saw them arrest him as I was leaving.

something like over $2000 in damages and hello, its a federal crime... all 18... wonder where they spent the night :)

How can he get a dwi if the cop showed up and he wasn't driving? That's illegal.

He was charged with DWI not convicted of DWI. He still has to go to court and can fight it.

He probably will win that one. You must be "in physical control" of the vehicle, and that could simply mean you in driver's seat with keys in ignition. These laws are pushed heavily by MADD.

if there is proof or a witness that will say that that person was driving the vehicle then thats all they need, i know if u pass a school bus wen the lights are all on and the kid crossing sign is out, all the bus driver needs is to know if its a male or female and a rough identification and plates then they get billed the ticket and a sommons........
also if someone cuases an accident and flees and alchohol is found in their blood then enless they can prove they werent drinking they get charged for it too.....or at least thats what im told....

In Pennsylvania you can get convicted of DUI for sitting behind the wheel in a parking lot, even if the keys aren't anywhere near the car.
Too drunk to drive home so you decide to sleep it off in the bar parking lot? DUI.

Happened to me... Actually was assisting my drunken ex back in 2001 and just my luck a cop pulls up. She had a BAC of 0.22 and I only had a 0.083. She ended up having her insides flushed while I was "paper" arrested.

True. And he was clearly in the wrong. But cases like that are easily won :disgust:

Well done sir. You obviously did the right thing. I think he'll lose with the added factor of the child in the car. Hopefully anyway, drunk driving is bull ****.
I just called dui on a "friend" a few nights ago. Obviously I have no respect for him anymore, and unfortunatly he wasn't caught. On the bright side, no one else got hurt.

good job dude! and way to be on the ball. That guy should be shot for having his kid with him.. Yeah a friend of mine got arrested for DUI she was walking to a car no keys or anything, the doors were unlocked and someone started the car from the cars key phob while she was in the car, now that is BS because you can't go anywhere anyways.
