---this is the continuation of my previous post---hey sorry guys i didn't update sooner, been really busy with a buncha schizz in the homelife :) anyways...

i went to court with my buddy and explained our case to the judge. (see previous post)

well, it turns out that none of the cops filed ANY paperwork, aside from the ticket. when the judge found this out, she called the police station and got nowehere. the prosector didn't like the fact that i was going to get off so easily, so she walked her fatass (i hate to resort to name calling, but she really pissed me off) and asked that the police be allowed an extension! wtf? if i didn't show up for court or file any paperwork, would they have given me one? no...

so now i have to go back october 4th....

the penalty if i plead guilty: 1 year license suspension...$2000 fine...$400 court fees.
a guy who got arrested for a DUI and plead guilty: 6 months license suspension...no fine...attend AA...court fees.

this is bull$hit.

----UPDATE----

They offered us a plea agreement...1 year license suspension, 6 months probation, $300 in fines, 15 hours community service, and a traffic class. As soon as I saw it I laughed and threw it out...

Wound up waiting for 5 hours... finally my buddy and I got called up. After giving a brief reminder to the judge, she looked over at the prosecutor. Again, the police officers failed to file any paperwork. The prosecutor had called and gotten their side of the story. The only thing they said was they 'heard' us racing. I quickly pointed out to the judge they only heard us, not saw. She asked the state if it were possible to throw this case out, she said that she believed our story and thought we did a great job representing ourselves...

The prosecutor said no, she still wants to prosecute. Trial by jury, our actual court day will be set Tuesday.

I've decided to get a public defender, the lawyer I wanted was $1500...

Get a good lawyer.

Hmmmmmm......You have luck just like me....welcome to the club. I got screwed into two years probation last november for something I did 3 years ago.

i was hoping to not have to hire a lawyer...im like broke because of an apartment im getting and stuff i need to get for it...down payments get expensive...but...the lawyer seems like my only solution...

ive been contemplating suing the state for wages lost...and emotional damage....i know the first might hold up but the second would be kinda hard to win.

Get a lawyer, you'll win this one easy. If you can't afford a lawyer, at least look around and try to figure out how to bypass their request for a continuation.

I got a lawyer-$300 and got 1 year prob and $250 fines

OK, so you can get a 1-year suspension, $2000 fine, and $400 for "street racing" (even though the cops were 3 blocks away from the intersection you raced at), but a DUI gets a 6-month suspension, and no fines/fee's?

I still don't see how they have a leg to stand on with those charges. I'm simply amazed the judge didn't throw it out then.

Is street racing a BIG problem in your town? I.E., is it something that they want to absolutly blister everyone they think may be doing it? That could be a reason they gave them an extension, to try to get "those damn street racing kids".

why does everyone laugh at a cavy. i like them and that one we put ALOT of stuff into that car. i worked really hard on it

Cavis arent bad its just they have a bad body design... not very elegent lines at all. I always respect the work people put into any car, but i think you should start your masterpeice with a proper canvas.

If you decide to get a public defender, they usually don't try to get you off the hook. They just try to lessen to offense so get a lawyer if you're trying to totally expunge this.

Good luck I hope you guys do well don't give up or they will really nail you to the wall. That's our fantastic court system though "ummm yeah the cops didn't do their job they don't even really have a case anyway...but we're going to give them an extension and make you take more time off of work or school" YEAH THANKS A_HOLES.....you go to hell and you DIE!

You know, I'm not sure about the legality of having to take you to court after this, but this is pretty stupid.

Call the local media and tell them what happened, tell them you're being persecuted. Court records are public documents.

Make this out to be a big deal. Find out everything you can on this prosecutor. If they want to make your life hell, you should return the favor by making this into some kind of media scandal. :)

The judge should have dismissed the case Period. and the A-hole thats after you sucks. Go for the media, Tell your local alderman or community leader that they have no proof and that your part of a witch hunt. Call the prosecutor every day and ask simple questions about your case like... If by law you have no proof then why spend Public money on a case without evidence??. the prosecutor deserves a:kick:

EXACTLY! I'm sick of seeing public money wasted on crap like this. If he didn't do anything wrong and his case is so airtight the judge said "I'm ready to throw this out" then it's a WASTE of TAXPAYER money on a witchhunt for someone trying to make themselves look good.

It's not a "California mentality" it's a "You mess with me and my car, I mess with you" revenge mentality. ;)

Well you are definitely in a Chess Match. I think you are handling it very well. Just remember to stay CALM and Think before you say anything.

Calling the prosecutor is a bad idea. Harassing someone who could potentially know the judge or people handling the paper work in your case is a horrible idea. Plus LOL they could prosecute you for harassment!

I would recommend contacting your local media "5 on your Side" or whatever it is and calmly explain your case. You might get a freebie attorney or something. You might also want to politely talk to the judge about your case and possible courses of action. The judge might be able to offer some great advice.

Just remember that the people who decide your fate are only going to see you for 15 minutes at a time! Make a good impression. If a nice looking person comes in and is respectful you might get a nice break. Who knows maybe the person before you was an a-hole thug law breaker. You'll look like nice law abiding citizen.

Take your time, be thorough - document everything and don’t give up!
