Hey guys,

So coming home a few weeks ago, I was stopped coming into my town. Usually our police is pretty cool with the locals, but either this guy had it in for someone, or I talked myself into the ticket (I think the later). Basically all the streets in my town are 1 ways with a few exceptions, and most intersections have stop signs. The street I normally come in on is a one way with only one stop sign the whole length, so I use it litterally every day.

I was about 3/4 of the way down the street to my house, when I noticed lights behind me. I know I stopped at the only stop sign at the begining of the street, as there was cross traffic. I start pulling over to the side expecting the cop to go around me, as I was not speeding (narrow streets, lots of kids and peddestrians and double parked cars make it almost impossible even if you want to). Well anyway the cop pulls in behind me. I think to myself, oh, he must be going here, and start pulling away. Well he toots his horn and points at me to let me know he is actually stopping me. I turn off the car and wait for him.

When he comes up to the car he asks for license and registration (strangely no insurance). I give him my paperwork and he then asks if I know why he stopped me. I said, honestly, no, as I was not speeding, and there were no stop signs for me to pass through that I may have missed, seeing as I come this way every day. He replied that I did not slow down while going through the intersections. I said that I was unaware I had to (honestly being civil, I have the utmost respect for police), seeing as there were no pedestrians around and the other directions all had stop signs. I did not even have so much as a yeild. His response was that it was a state law that you had to slow down going through all intersections. I apoligized, said I never heard of it, but would make a point to be more careful in the future. He then went on again saying how it was a state law, and he saw me pass through 3 intersections without slowing. Once again I apoligized (honestly not being a wiseass, and being civil). He then went back to his car and came back with a 2 point careless driving ticket.

Well I need to go to court for it now. What I know is the town will lower it to another ticket with no points but the same 120 dollar fine. A friend of mine got into a similar situation a few years ago. He took the plee, but his insurance still went up. At this point my license is clean, so I do not really care about dmv points, I just do not want my insurance going up. I did some checking and found no law stating that you had to slow down in intersections. The only mention I found was in the driver handbook it says you "SHOULD slow down when entering unfamiliar intersections". However, the law for careless driving that I was cited with is extremely vague. More or less anything considered to be the police officers opinion of careless driving can be considered that, regarless of if any other laws were broken.

Basically if I accept the deal, my insurance will go up 200 bucks a year, which is high enough seeing as where I live. If I fight it and loose, not only does my insurance go up, but now I get DMV points and have to pay extra court costs as well.

Anyone here ever get a careless driving in NJ, and if so, fight it successfully?

if you get a ticket ammended to another term with no points, your insurance will not go up..... when you go to court you can ask them to ammend it to the ticket code # 39:4-97.2 which is an amendment from careless driving (2 points, which is 39:4-97) to unsafe operation of a motor vehicle (0 points, no insurance surcharge, $180 max fine) but i would fight the ticket balls to the wall because this state law you must yield at intersections with no signs is complete b/s there is no law like that

:rofl:that is one of the funniest things ive ever heard. i dont think i could have kept a straight face if a cop told me that i didnt slow down for an intersection that had no light, stop or yield sign. i live in pa so im not too firmiliar with nj laws but i cant really see that being a law or there would be a million accidents a day and people would never get where they wanted to go. i think you should fight it and i cant see why you wouldnt win. First off he said that you should slow down at unfirmiliar intersections but if you live right there then to you its not unfirmiliar so even if it is a law you had no reason to slow down cause you knew where you were. i couldnt imagine slowing down at every intersection i pass everyday, it would take me at least twice as long to get where im going and you would probably need new brakes in half the time. i have never been pulled over in nj but judging by what ive read on here i never want to be, especially being an out of state driver. good luck in court.

Yeah Joe...dont ever get pulled over in Jersey, they especially hate outta-staters down here....

As for careless driving, it's basically the i wanna nail ya so im using the most general term in the book......it covers everything under that, it should just be a fine and no points...save some trouble...

Seriously, i got that ticket because my car hydroplaned off the road no damage but i got a ticket, you got it for some unknown law, i've known people to get it for turning right in a single lane road by using the shoulder which everyone does, etc....

As for successfully fighting it...i'll let ya know Wednesday night after my court date :disgust:

I'm sure you'd win something like that, that's just ridiculous. you said you got it a few weeks ago...was it near the end of the month? I got a ticket for neons AND speeding which are both laws and I walked away from court with 0 points, but was alittle bit poorer.

Actually got it at the beginning of the month, so I do not think it was any type of quota thing. I think if I started off with an I'm sorry type of deal he would have let it slide, but I honestly didnt do anything wrong.

While Unsafe operation does not always carry insurance points, some carriers may assess it to you, its what happened to my friend.

Good luck in court Tef.

I guess the question really at hand is what is more important, a few hundred bucks, and some wasted time, or principal.

Getting a ticket SUCKS big time:( But from my driving experience, I often watch my speed going through intersections especially in cities and older sections of towns. I will often, but not always, slow down to just below speed limit just to make sure nobody is blowing by a stop sign and so I can attempt to stop or manuver if needed to. In Hoboken, parked cars can block your vision and that of the other drivers at an intersections and probably the cop has seen too many accidents and people hurt at intersections (and hates to do the accident paperwork) :shrug: So try to get it pleaded down so get 0 points and keep the insurance from going up 100'S of $$$ per year for a few years. The insurance co's are desprite to find new $'s and will look for any excuse to raise your rates. :cool:

he's somewhat right about slowing down through an intersection. I do that now ever since I witnessed a car getting smashed by somebody blowing through a stop sign, and the car that got smashed was doin' about 20mph in a 25 too.

Well....court was really fun actually :biggrin:

Judge was making jokes and i was by far not the worst person there. The prosecutor was really whackin people with fines, etc...he's petitioning for 15 days of imprisonment to a 15 year old kid that got caught on a moped, crazy stuff. Couple kids got nailed for street racing on the parkway (dumb)

So i walk to the stand, judge compliments me on how i was dressed (button down blue ****, light khakis, brown shoes, class ring, pocket watch, hair done up nice) and my goat-tee......said i looked "cool"

Prosecutor dismissed my ticket, said that spot i went off the road was a notoriously bad spot for hydroplaning and dismissed it.

And to better fit....the prosecutor was my neightbors brother-in-aw and we've had bar-b-ques with him, and my mom taught him many moons ago...gotta love coincidence :)

Incidently...everyone else less fortunate then me (i was the only one dismissed) all pleaded down to 39:4-97.2 which was $50-$150 fine for first offense....

Congrats on the ticket man.....Damn, I wish I could pull off a pocket watch.

Thats the one fun thing about court, theres always people in there to make whatever you did look trivial.
