ok well I got another ticket on Wed. it was for 46 in a 30. I asked the cop to see the gun and he said that he didn't get me locked in and didn't get the exact read-out. I know I was speeding but i was only going like 40 and I all ready ahve 4 points on my license. Is there anything I can do to get out of it or at least get it knocked down? He told me because a car turned in front of him that he could get my exact spped or my car locked on, so how could he say I was doing 46 when I know I was not going over 40. I'll take 40 but 46 well get me more points cuz of recklace driving.
I would fight it....you still might lose, but it's worth a shot.
Or call 1800-citation, and let a traffic lawer do it for you. It usually costs between $75 and $100. SO far I am 3 for 4 using the ticket clinic.

in court, ask him how he could verify it was your car if he didnt lock it in. he wouldn't show you. that is kinda strange there. and secondly it depends on location, but in cali, they have to survey streets every 5 years before using a radar gun. check with your city civil engineering department and see if they have such a law. i got out of a 65 in a 40 on that one, it hadnt been tested in 8 years, voila, ticket excused.

There are usually other laws governing use of a radar gun to give someone a ticket. I know that in California, cops also have to recalibrate their radar gun after they've used it.. so if they say they clocked you on Radar, ask to see their recalibration log. :) I recommend searcing the web for radar laws in your state. But if he did not have you locked in on the radar, and he said so, and he did not pace you, then I'd go to court. Sounds like an easy win to me (And my roommate law student agrees. :))...

anymore I just keep it at 9 above limit. Been caught doing that by police all the time and they don't bother to pull me over...I think I found the magic number.

hey aelle2000 I asked for advice about my situation and didn't ask anywhere for u to chime in with that comment. Did I say once I wasn't speeding? NO! I just want the ticket for what I was actully doing. If i was doing 46 then I wouldn't have said a thing, but I was only going at most 40, so I want my ticket to say I was going 40 not 46 those 6mph mean a lot between speeding and recklace driving for me, so next time i'll ask for thoughts if i want them, and if i don't please don't be b*tchin at me. thank you.

i agree with the idea of fighting the ticket. i got pulled over going 110 in a 55 by a state trooper. he was going to give me wreckless driving but instead gave me unsafe lane changing. i went to court (even though i was thinking that unsafe lane changing was a lot better than wreckless lane changing). well, the trooper showed up and stood next to me while the judge questioned me. the judge asked me if i felt that i was being unsafe. i (of course) said no. then the judge proceded to say that only i can say whether or not i was being unsafe and that he hated this law. the case was dismissed with me getting nothing. the trooper did stop me on the way out of the courtroom and say that he should've given me the wreckless driving ticket. he also mentioned that my "pretty face" won't get me out of trouble all my life. so, moral of the story...fight it because you never know what will happen.
ps-they schedule hearings for traffic violations on cops days off so if the cop has something planned then he won't show up and you get off. one of the perks of my father being a PG county cop and my fiances dad also being a PG county cop.:)

oh shuttup mr sour puss. peoiple shouldn't get tickets for going 5-10 over.. ok if your goin like 50 over then i guess ya could make fun of em when they whine but jeez quite bein such a frickin Nun.

I was told by a GA cop that to account for incorrect speedo calibrations, 10mph is allowed unless you get stopped by state patrol (god's police around here or something). Also, if he didn't lock you in he has no case cause that's estimation...which I would think would be falsification of a ticket on his part...
