Garbage truck nailed for street racing

Linda Nguyen, Canwest News Service Published: Thursday, April 24, 2008

A garbage truck has been impounded and its driver faces charges in what is believed to be the first case of a commercial vehicle snagged by Ontario's new street racing legislation.

"I don't think this guy is going to get the employee-of-the-month prize anytime soon," Const. Joanna van Mierlo of the Huron County detachment of the Ontario Provincial Police remarked Thursday.

An OPP officer clocked the truck speeding at 112 km/h in a 60 km/h zone Wednesday in the small town of Goderich, Ont., about 200 kilometres northwest of Toronto.

Police stopped the tractor-trailer-sized truck in a two-laned paved road in a small hamlet that they had chosen to target.

"We had identified a number of areas in the county to be problem areas," Const. van Mierlo said. "As a result, this guy was pulled over during a direct speed blitz by our officer."

Const. Van Mierlo said the truck belongs to a private garbage contractor and the driver was working at the time.

"I think this is the first commercial vehicle to get pulled over for street racing," she said. "It's pretty significant, considering large commercial vehicles have a harder time stopping on a dime."

The truck has been impounded for seven days and the driver's licence has also been suspended for a week.

Jacob Hovius, 58, of Clinton, Ont., faces one count of racing and one count of failing to inspect his motor vehicle. He is set to appear in a Goderich court on June 5.

On Saturday, Windsor, Ont., OPP charged a 26-year-old man with serious speeding infractions after he was stopped for attempting to pass a marked police vehicle while driving at 178 km/h. His licence was also suspended and his vehicle impounded.

The tougher street racing legislation came into effect in the province last September.

It gives police the ability to impound a vehicle and suspend a driver's licence for seven days each, and to issue a minimum $2,000 fine if a driver is caught going 50 kilometres over the posted speed limit.

There was a good point made in that article.....Its even more dangerous for a truck to be speeding like that, because its much much harder to stop. Especially going from 112 - 0 versus 60 - 0. I dont' know if anyone here has been to Goderich, but its a small town and the streets are tight. A person could walk out and there is very little warning.

Personally, I think the penalty should be higher for commercial drivers. They are deemed 'professional drivers' when they hold a class A, B, C, D, and F. They are trained to a higher standard and thus should be held to a higher one.

I agree he was speeding excessively and should have the book thrown at him. But Street Racing, come on!

Thats just a technicality in use of terminology. I think that was more the media's spin.

But yea....When you read it, it sounds pretty lame.

'Reckless Negligence' would be a better blanket term to use.

Its simple Mark...

"Street Racing" = news

"Speeding" = not a 'catchy' title, and its less likely anyone would read the story or think it was a big deal.

I totally agree with you - IMO, street racing should be an offense reserved for those who are involved in 'racing' another vehicle. For traveling twice the posted speedlimit, whats wrong with keeping the 'excessive speeding' & 'careless driving' charges.

They just like calling it "street racing" because it sounds better.

I read about this yesterday and agree that the headline/law is very misleading.

Can you street race by yourself?

And I agree, they're given a higher level of training, so should be held to a higher level of responsibility.

With our Roller Coaster court system, you can make a valid argument for anything.

The SCC just ruled that sniffer dogs cannot be used in any circumstance unless a specific warrant has been issued against a specific person.

I know around here you can get a ticket if you take off from a light aggressively but just speed up to the speed limit.

They consider that "excessive display of horsepower".

yep, thats in the new "street racing" law as well. Its the same consequence as doing 50 over.

our new law states that driving 50+ km/h over the limit, squeeling ur tires, street racing, and "trick" driving are now considered street racing and you will lose ur car for a week on site, and your license. Plus at a minimum get a 2000$ fine.

Calling it street racing just has more "shock" value...

There were still perfectly good names for everything before, but its like... what sounds more important - Catching a criminal? or catching a terrorist!

^^ brings up a good point... does it really matter what its named.. but i do agree on the drivers getting bigger penalties. this is just the first of its kind so its something they pobly didn't think happened all that much and wasn't a worry factor to change the law for those specific drivers.. but in either case i do see this going to be an issue with making new laws in the near future.

Street racing?!?! omg..that's just lame. It's a serious problem, and needs to be dealt with harshly, but, a jerk speeding in his garbage truck along a residential street by himself cause he was behind, or wanted to leave early, is not street racing. All they are doing, by making that "news" is making the street racing law, a joke.

Reckless driving, careless driving, dangerous driving, etc etc..there are several other more appropriate laws they could've reported him on.

Plus if you read more into it he was doing 112 in an 80 zone so 32 over. Still speeding but not Crazy fast. They nailed him right where the speed limit dropped to 60. Talk about Speed trap.

Yea but there is always a sign that warns of the speed limit going down, so you have time to slow down. If he failed to reduce his speed by the time the 60 zone came up, then who's to blame?

If the sign wasn't there, for some obscure reason, then he's got a case.

The bottom line is he was going pretty damn fast. Call the charge whatever you want, nit-pick at the name, but it doesn't change the fact he was driving wayyyyy too fast for the area. Even if this law was non-existent, 112km/h entering a small town on a single lane road is just retarded. Very irresponsible behaviour.

The guy can probably argue that there was no warning sign of a slow down coming up. Its like going into newmarket on Davis from bathurst, that quick slow down to 60 right at the bus station. I see traps in there all the time. i argued with a cop that i was no going 90 in the 60 i was going 90 in the 80 and had promptly slowed down WITH traffic going into the 60.
FOrtunatly his supervisor was there and heard my arguement, he checked the aiming of the gun and told me to go on my way.

It's just funny how they don't put up speed traps around school zones or senior citizen centers. It's in the places they can generate the most revenue. Serve and Protect my ass, they don't give a rats ass about anyone. I always hate when cops give me that speech about them caring about my safety. B.S. they just say that so they feel better themselves, another selfish act. :gtfo:

Oh I got a good one for ya then. lol

They are always setting up a speed trap by my house. So I get off the bus one day and question the cop about the saftey aspect of what they are doing. I won't get into the deets, but its not the best spot to be doing the trap. So he makes his defense, and I tell him that maybe they should focus their efforts on the thugs and red light runners. He comes back with: "Well you would be surprised how many guns and weapons we pull from peoples vehicles during these traps."

I laughed so hard. I said to him that maybe if you started raiding a few more appartments, instead of the Tim Hortons, they might find 20x as many guns, weapons, drugs, stolen goods....What a crock of poo.

They could change so that excessive speeding results in a charge fo being a terrorist. That would make the news more interesting.

Thats why i like to be the jackass to warn oncoming traffic of upcoming speed traps. Just to stick it to the MAN!!!! lol

One thing that has started to scare the crap out of me since an incident about a month ago, i drive down alot of country roads now and they are very hilly. alot of people don't grasp 2 concepts.
1) turn off your ****ing high beams when peaking over a hill, your high beams don't see any further then your low beams on those inclines and it wont make difference except to blind the on coming car that you didn't know was coming because you couldn't see his dim lights.
2)Don't pass going up hill, You can not see any oncoming cars over the hill. I nearly got nailed by this pickup passing another pickup last month by some jackass doing this. Fortunatly my brakes slowed me down enough that i could swurve around him onm the shoulder as he jacknifed back into his lane. really ****ing close call

Keswick is good for drivers like that, lemme tell ya.

there's a cop here, likes to set up his speed trap, directly beside the 60 sign when coming offt the hwy at 80. How's that for rude.
